Australia has introduced a significant reform affecting international students whose visas are refused. The new law changes how appeals are handled and removes the automatic right to an in-person hearing.
📌 What Has Changed?
Previously, international students already in Australia who were refused a visa had the right to:
- Appeal the decision at the Administrative Review Tribunal (ART)
- Receive an in-person (oral) hearing as part of that appeal
🔄 New Rule (Passed February 2026):
ART is no longer required to provide an in-person hearing in every case.
Instead, the tribunal can now:
- Decide appeals based only on written documents and submissions
- Finalize cases without face-to-face hearings
This reform was passed by Parliament with support from both the Labor government and the Opposition.

The government says the system is overwhelmed.
Massive Increase in Appeals:
- 2022–23: Just over 2,000 appeals
- 2023–24: More than 11,500 appeals
- 2024–25: Over 32,000 appeals
- Nearly 50,000 cases still waiting
- Average decision time: 1 year and 4 months
Student visa cases now make up more than one-third of all ART cases.
Government’s Argument:
Attorney-General Michelle Rowland stated that:
- Oral hearings are time-consuming and resource-heavy
- Faster written decisions will reduce delays
- Backlogs encourage non-genuine applicants to appeal just to extend their stay
The reform is meant to improve efficiency and integrity of the migration system.

Not everyone agrees with the change.
Concerns Raised:
- The Greens argue it removes a “basic right” for students
- The Law Council of Australia says oral hearings are sometimes the only fair way to resolve cases
- Migrant rights groups worry it could lead to more poor-quality decisions
Key Issue:
Nearly 50% of refused visas are overturned at ART. Critics argue this shows that many original decisions may be flawed.
