Where the Proposal Stands

  • DHS submitted the rule on June 27.
  • The White House Office of Management and Budget (OMB) reviewed it and approved it “with changes” on August 7.
  • Next step: DHS will publish the proposal in the Federal Register for public comment.

Why This Matters

  • Most students take more than four years to finish a degree — especially PhD students — meaning almost everyone would have to apply for an extension of status.
  • Even students who finish in four years but want to work in the US under Optional Practical Training (OPT) would need an extension.
  • This process would:
    • Add extra paperwork and costs (legal and government fees).
    • Increase risk of errors in applications.
    • Put huge strain on USCIS — with estimates of 300,000+ extra applications every year.
    • Cause longer processing delays.

The Bigger Picture

  • This is similar to Trump’s 2020 proposal, which Biden withdrew, but experts expect the new version to be very close to that old plan.
  • It comes alongside other US visa policy changes (shorter visa validity for certain countries, interview suspensions, etc.).
  • These policies are already making the US less attractive to international students, with enrolment predicted to drop by 30–40% this fall.
